Terms of Service
Last Updated: August 31, 2026
Risk Disclosure. Futures and day trading involve substantial risk. You can lose more than your initial investment. Past performance does not indicate future results. Never trade with money you cannot afford to lose. Consider consulting a qualified financial advisor before making trading decisions.
1. About These Terms
These Terms of Service (“Terms”) are a binding agreement between you and MarketEye, LLC (“MarketEye,” “we,” or “us”), a Wyoming limited liability company. They apply when you visit marketeye.io, create an account, or purchase or use any of our services.
If you do not agree to these Terms, do not use our services.
1.1 How These Terms Relate to Our Other Agreements
Three documents govern your relationship with us, each covering a different subject:
- These Terms of Service govern your use of our website, your account, and all commercial matters — pricing, billing, renewals, cancellation, refunds, intellectual property, and disputes.
- The Community Agreement governs participation in the MarketEye Society community — conduct standards, community rules, and the associated risk waiver.
- The Privacy Policy governs how we handle your personal information.
All three are incorporated into your agreement with us. If a conflict arises between these Terms and the Community Agreement on a commercial matter — pricing, billing, refunds, or dispute resolution — these Terms govern. If a conflict arises on community conduct or participation, the Community Agreement governs.
2. Our Services
MarketEye provides online educational content and a membership community relating to futures, forex, stocks, options, and cryptocurrency trading. Depending on your membership, this may include educational materials and tutorials, community forums, live sessions and market commentary, mentorship, and periodic newsletters.
We may modify, suspend, or discontinue any part of our services. Where a change materially reduces what a paid membership provides, we will give notice as described in Section 12.
3. Eligibility and Your Account
3.1 Who May Use Our Services
To create an account you must be at least 18 years old and a resident of the United States. We do not offer or direct our services to residents of the European Economic Area, the United Kingdom, or Switzerland. You must have legal capacity to enter this agreement, must not be barred from using our services under applicable law, and must provide accurate registration information.
By creating an account you represent that you meet these requirements. We may suspend or close the account of anyone who does not.
3.2 Account Security
You are responsible for your account credentials and for activity under your account. Accounts are personal — do not share your login, and do not use your account on behalf of anyone else. Tell us promptly at [email protected] if you believe your account has been accessed without your permission.
3.3 Electronic Communications
By creating an account you agree to receive communications from us electronically — by email or through the platform — and you agree that electronic agreements, notices, and records satisfy any legal requirement that such communications be in writing. You may unsubscribe from marketing emails at any time; you will continue to receive messages about your account and our services.
4. Memberships, Pricing, and Billing
4.1 Pricing
Current plans and prices are shown at checkout and within the membership platform at the time of enrollment. The price presented to you at checkout, together with the billing terms shown there, governs your purchase. All amounts are in U.S. dollars.
We may change our prices. A price change does not affect your current billing period; it takes effect at your next renewal, and we will give you at least 30 days' notice by email before it does. If you do not accept a new price, you may cancel before it takes effect.
4.2 Membership Types
We offer the following, each of which is described in full at checkout:
- Free Membership. Access to designated free educational content at no cost. No payment method is required.
- Recurring Paid Memberships. Access to paid educational content and the membership community for a recurring fee billed on the schedule shown at checkout, continuing until cancelled.
- Lifetime Curriculum Access with Community Subscription. This
plan has two separate parts, and you should understand both before purchasing:
- A one-time payment that grants ongoing access to the MarketEye curriculum for as long as we offer it, with no further charge for that access.
- A separate recurring monthly fee for access to the membership community, which is billed monthly and continues until you cancel.
These are not the same thing. If you cancel the monthly community subscription, you keep your curriculum access and lose access to the community. The one-time payment does not cover the community fee, and the community fee does not expire on its own.
“Lifetime” refers to the period during which MarketEye continues to offer the curriculum. It is not a guarantee that the curriculum, the community, or MarketEye will operate for any particular length of time. If we discontinue the curriculum entirely, Section 12.2 applies.
4.3 Free Membership
The free membership costs nothing, requires no payment method, and is not subject to Sections 4.4 through 4.7. Accepting these Terms when you create a free account does not authorize us to charge you. We will only charge you if you separately purchase a paid membership and expressly agree to its terms at checkout.
4.4 Automatic Renewal
Recurring memberships, including the monthly community subscription described in Section 4.2, renew automatically at the end of each billing period until you cancel. Before you are charged for the first time, we will present the billing amount, the billing frequency, the renewal terms, and how to cancel, and you will be asked to affirmatively agree to them. We will send you a confirmation of those terms after purchase.
You may cancel at any time before your next renewal date to avoid the next charge.
4.5 Cancellation
You may cancel a recurring membership or the community subscription at any time through your account settings, or by emailing [email protected]. Cancellation takes effect at the end of your current billing period, and you keep access until then. We do not require you to speak with anyone to cancel.
4.6 Refunds
Seven-day refund period. You may request a full refund of any purchase within seven (7) days of the date of that purchase, for any reason, by emailing [email protected]. We will process approved refunds to your original payment method within a reasonable period.
This applies to first-time purchases, including the one-time payment described in Section 4.2. It does not apply to automatic renewals of a recurring membership after the first billing period — to avoid a renewal charge, cancel before the renewal date under Section 4.5.
After the seven-day period, payments are non-refundable and we do not provide prorated refunds for partial billing periods, except as stated in the next paragraph.
If we terminate your paid membership for reasons other than your breach of these Terms, we will refund the unused portion of your current billing period.
4.7 Failed Payments
If a payment fails, we may retry it and may suspend access until payment succeeds. If payment is not resolved within a reasonable period, we may close the recurring membership or community subscription. Curriculum access purchased under Section 4.2 is not affected by non-payment of the community fee.
4.8 Taxes
Prices exclude applicable sales tax, which we will add where required by law.
5. Acceptable Use
You agree not to:
- Break any law or infringe anyone's rights;
- Post content that is unlawful, threatening, abusive, defamatory, obscene, harassing, discriminatory, or hateful;
- Impersonate anyone or misrepresent your identity or affiliation;
- Share your login, or give non-members access to paid content;
- Copy, record, redistribute, or resell our content without written permission;
- Reverse engineer or attempt to derive our proprietary systems or methods;
- Introduce malware, attempt unauthorized access, or interfere with our services;
- Scrape or use automated tools to access our platform;
- Send spam or unsolicited commercial messages to other members;
- Present yourself as licensed to give financial advice, or give personalized investment advice to other members.
Conduct standards inside the community are set out in the Community Agreement.
6. Educational Content — Important Disclaimers
6.1 Educational Purposes Only
Everything we publish — content, analysis, commentary, strategies, and discussion — is educational and informational only. None of it is investment, financial, legal, or tax advice, and none of it is a recommendation to buy or sell anything.
6.2 We Are Not Advisers
MarketEye, its mentors, and its members are not licensed investment advisers, broker-dealers, or commodity trading advisors, and do not provide personalized investment advice. You make your own trading decisions and bear their consequences.
6.3 Trading Risk
Futures, forex, stocks, options, and cryptocurrency trading involves substantial risk and is not suitable for everyone. Futures are leveraged instruments; you can lose more than your initial investment. Only risk capital — money you can lose without affecting your financial security or lifestyle — should be used for trading. Past performance does not indicate future results, and no strategy is guaranteed to be profitable.
6.4 Results and Testimonials
Any results, testimonials, or case studies we publish describe the experience of specific individuals in specific market conditions. They are not typical, and they are not a promise or projection of what you will achieve. Individual results depend on skill, capital, market conditions, discipline, and factors outside anyone's control.
6.5 Hypothetical Performance
Hypothetical or simulated performance results have inherent limitations. They do not represent actual trading and may under- or over-compensate for the effect of market factors such as lack of liquidity. No representation is made that any account will achieve results similar to those shown.
7. Intellectual Property
7.1 Our Content
All content we provide — text, video, audio, images, software, templates, indicators, curriculum, and materials — belongs to MarketEye or its licensors and is protected by intellectual property law.
7.2 Your License to Use It
While your membership is active and in good standing, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view our content for your own educational use. This license does not permit you to download, record, or store content except as your browser caches it automatically; share access or redistribute content; use content commercially or to build a competing offering; or modify content or create derivative works.
This license ends when your membership ends. For curriculum access purchased under Section 4.2, the license continues for as long as we offer the curriculum and you remain in good standing under these Terms.
7.3 Content You Post
You keep ownership of what you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your content within our platform for the purpose of operating the service, and to permit other members to view it in the ordinary use of the community. This license ends when you delete your content, except for copies retained in backups or already shared with other members.
You are responsible for what you post and confirm you have the right to post it. We may remove content that violates these Terms or the Community Agreement.
7.4 Feedback
If you send us suggestions about our services, we may use them without obligation or compensation to you.
7.5 Copyright Complaints
If you believe content on our platform infringes your copyright, send a notice with the information required by the Digital Millennium Copyright Act to our designated agent:
DMCA Agent, MarketEye, LLC
Email: [email protected]
Address: 30 N Gould St Ste R, Sheridan, WY 82801
We will respond appropriately, including removing infringing material and terminating repeat infringers.
8. Third-Party Services
Our services rely on third-party providers, including the platform that hosts our community, and our site may link to third-party websites. We do not control them and are not responsible for their content, practices, or availability. Your use of them is governed by their own terms. We may change providers, and your membership continues if we do.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that our services will be uninterrupted, timely, secure, or error-free, that content will be accurate or complete, or that any outcome will result from using our services. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this Section may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETEYE AND ITS OFFICERS, MEMBERS, EMPLOYEES, MENTORS, AND AGENTS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, exemplary, or punitive damages;
- Lost profits, lost revenue, lost data, or lost business opportunities;
- Any trading or investment losses, however arising, including losses following use of our educational content;
- Errors, inaccuracies, or omissions in our content;
- Interruption or unavailability of our services;
- Unauthorized access to your account; or
- The conduct of other members or third parties.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or any liability that cannot lawfully be limited.
11. Indemnification
You agree to indemnify and hold harmless MarketEye and its officers, members, employees, mentors, and agents from claims, damages, losses, and reasonable costs (including attorneys' fees) arising from your breach of these Terms, your use of our services, content you post, your trading or investment decisions, or your violation of any law or third-party right.
12. Term, Suspension, and Termination
12.1 By You
You may cancel a recurring membership under Section 4.5, and you may close your account entirely at any time by emailing [email protected]. Closing your account ends all access, including curriculum access purchased under Section 4.2. Deletion of your personal information following closure is handled as described in our Privacy Policy.
12.2 By Us
We may suspend or terminate your account if you breach these Terms or the Community Agreement, if we reasonably suspect fraudulent or illegal activity, or if required by law. Where circumstances allow, we will give notice and an opportunity to correct the problem. If we terminate a paid membership other than for your breach, Section 4.6 applies.
If we permanently discontinue the curriculum, we will notify holders of curriculum access purchased under Section 4.2 at least 30 days in advance and will provide a reasonable opportunity to retain or download the materials to which they have access, to the extent we are able.
12.3 What Survives
Sections 6, 7, 9, 10, 11, 13, and 14 survive termination, along with any other provision that by its nature should survive.
13. Disputes
Please read this Section carefully. It affects how disputes between us are resolved and limits your ability to bring a lawsuit or participate in a class action.
13.1 Talk to Us First
Before starting formal proceedings, contact us at [email protected] with a description of the problem and what you would like us to do. Most issues can be resolved this way. Both parties agree to attempt informal resolution for 30 days before proceeding.
13.2 Arbitration
If informal resolution fails, disputes arising out of or relating to these Terms or our services will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and its Consumer Minimum Standards of Procedural Fairness, rather than in court.
Arbitration will be seated in Los Angeles, California. You may elect to have the arbitration conducted by telephone or video conference rather than in person, and we will not object. Written-submission-only proceedings are available where the JAMS rules allow. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
13.3 Small Claims
Either party may bring an individual claim in small claims court instead of arbitration, if it qualifies.
13.4 Class Action Waiver
DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION, AND THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. If this paragraph is held unenforceable, Section 13.2 does not apply and the dispute proceeds in court.
13.5 Your Right to Opt Out
You may opt out of Sections 13.2 and 13.4 by emailing [email protected] within 30 days of first accepting these Terms, stating your name, the email on your account, and that you are opting out of arbitration. Opting out does not affect any other part of these Terms and will not affect your membership.
13.6 Jury Trial Waiver
To the extent a dispute proceeds in court, both parties waive any right to a jury trial.
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. This does not deprive you of the protection of mandatory consumer-protection laws of the state where you reside.
15. Changes to These Terms
We may update these Terms. We will change the “Last Updated” date, and for material changes we will notify registered members by email at least 30 days before they take effect. Continued use after that date means you accept the updated Terms. If you do not accept them, cancel your membership before they take effect.
16. General
- Severability. If a provision is held invalid or unenforceable, it will be modified to the minimum extent needed to make it enforceable, or severed if it cannot be. The rest remains in effect.
- No Waiver. Not enforcing a provision does not waive it.
- Assignment. You may not assign these Terms or your account. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force Majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
- Notices. We will send notices to the email address on your account. Send notices to us at [email protected] or the address below.
- Entire Agreement. These Terms, the Community Agreement, and the Privacy Policy are the entire agreement between us regarding our services, and supersede prior discussions and understandings.
- Relationship. Nothing here creates a partnership, joint venture, employment, agency, or fiduciary relationship between us.
