MarketEye Society Community Agreement
Version 2026-09-03.1 · Effective September 3, 2026
This page records a specific version of this agreement. The current version is always available at marketeye.io/community-terms.
This Agreement consists of two parts: the Community Agreement and the Waiver of Liability & Disclaimer. Both apply to all Members. Your use of the MarketEye website, your account, and all commercial matters — pricing, billing, cancellation, and refunds — are governed by our Terms of Service.
Part I — Community Agreement
This Agreement governs all participants (“Members”) of the MarketEye Society (the “Community”), operated by MarketEye LLC (“Community Operator”), including both Mentees and Mentors (paid and unpaid).
1. Purpose
The Community is an educational platform that facilitates the exchange of knowledge, strategies, and discussions related to futures, forex, stocks, options, and crypto trading. No investment, financial, or tax advice is provided.
2. Eligibility & Membership Rights
- The Community is a private membership organization.
- Admission is at the sole discretion of the Community Operator.
- Eligibility. Membership is offered only to individuals who are at least eighteen (18) years of age and who reside in the United States. The Community is not offered or directed to, and may not be joined by, residents of the European Economic Area, the United Kingdom, or Switzerland. By joining, you represent that you meet these requirements. The Community Operator may terminate the membership of any Member who does not.
- The Community reserves the right to deny, suspend, or revoke membership for any reason, including but not limited to conduct, communication, or affiliations inconsistent with the Community’s mission and values.
- No applicant or member shall acquire any vested right to membership.
- Membership Tiers. The Community offers a Free Membership, which provides access to designated free educational content at no cost and requires no payment method. Paid Memberships are also offered; their terms and prices are described at the point of purchase. All Sections of this Agreement apply to all Members regardless of tier.
3. Code of Conduct & Community Values
To maintain a constructive and respectful environment, all Members agree to uphold the following values:
- Respect for Equal Rights. Members must support and respect the principles of equality embodied in the Civil Rights Act of 1964, including nondiscrimination based on race, color, religion, sex, or national origin.
- Human Dignity. Members must recognize that all persons, regardless of immigration status, are entitled to basic human rights and to be treated with respect.
- Constructive Discourse. Members must avoid advocacy, promotion, or defense of ideologies, public officials, or policies fundamentally inconsistent with these values.
- Professional Integrity. Members shall engage with others in good faith, free of harassment, discrimination, or inflammatory political promotion.
Violation of these values, or conduct deemed by the Community Operator to undermine them, shall be grounds for denial or revocation of membership.
4. No Investment Advice
- All content, strategies, and discussions within the Community are for educational purposes only.
- Mentors and Community operators are not licensed investment advisers, broker-dealers, or commodity trading advisers.
- Members remain solely responsible for their trading and investment decisions.
5. Assumption of Risk
Trading futures, forex, stocks, options, and cryptocurrencies involves substantial risk of loss and may not be suitable for all participants. By joining, Members acknowledge that:
- They may lose some or all of their capital.
- They assume full responsibility for their trading and investment decisions.
6. Indemnification
Members agree to indemnify, defend, and hold harmless the Community, its operators, and all Mentors (paid or unpaid) from any and all claims, liabilities, damages, or expenses (including attorneys’ fees) arising from:
- The Member’s trading or investment activities;
- Reliance on any educational material, strategy, or discussion shared in the Community;
- Any violation of applicable laws by the Member.
7. Limitation of Liability
Neither the Community, its operators, nor its Mentors shall be liable for:
- Direct, indirect, incidental, consequential, or punitive damages;
- Losses relating to trading, investments, or profits;
- Any actions taken in reliance on Community discussions or materials.
This Section is subject to the limitations and exclusions set out in the Terms of Service, including the exceptions for fraud, gross negligence, and willful misconduct.
8. Intellectual Property
- All Community content (videos, guides, templates, strategies, indicators, and discussions) remains the intellectual property of MarketEye or the respective Mentor.
- Members may not share, resell, or reproduce Community content outside the platform without prior written consent.
- The license granted to Members to access and use Community content, and the license Members grant in content they post, are set out in the Terms of Service.
9. Payments, Subscriptions & Platform Access
Membership pricing, billing, automatic renewal, cancellation, and refunds are governed exclusively by Section 4 of the Terms of Service. Nothing in this Agreement modifies those terms. If you are a Free Member, no pricing applies to you and you will not be charged.
Free Members are not charged and are not required to provide a payment method. Accepting this Agreement does not authorize any charge.
Platform Access. The Community is delivered through a third-party platform. MarketEye LLC reserves the right to change the platform provider at any time. Membership will continue uninterrupted regardless of the platform used.
10. Governing Law & Dispute Resolution
This Agreement is governed by, and disputes arising out of or relating to it are resolved under, Sections 13 (Disputes) and 14 (Governing Law) of the Terms of Service. Those Sections include an arbitration provision, a class action waiver, and your right to opt out of both within 30 days.
11. Non-Compete & Non-Solicitation
- Non-Compete (Mentors and Paid Members only). This subsection applies only to Mentors and to Members holding a Paid Membership. It does not apply to Free Members. During participation in the Community and for a period of twelve (12) months following termination — or such shorter period as may be deemed reasonable and enforceable under applicable law — no Mentor or Paid Member shall directly or indirectly establish, operate, or participate in any business, program, or community offering trading education services that are materially derived from Community content, curriculum, strategies, indicators, or proprietary materials to which they gained access through the Community. This subsection restricts the use of Community-derived materials and methods; it does not restrict a Member from working in the trading education field generally.
- Non-Solicitation (All Members). No Member may solicit,
divert, or attempt to divert any other Community Member, Mentor, or prospect for
purposes of:
- Promoting competing trading education programs;
- Selling products or services outside of those expressly approved by the Community Operator; or
- Recruiting Members away from the Community.
- Exceptions. General business activity not specifically targeted at Community Members (e.g., publishing books, posting on social media, or teaching in unrelated industries) shall not be deemed a violation.
- Jurisdictional Limitation. Subsection 11.1 does not apply to any Member residing in a jurisdiction in which such restrictions are void, unenforceable, or unlawful to include in an agreement. In such jurisdictions, subsections 11.2 and 11.3 continue to apply in full.
- Enforcement. Any breach of this Section shall entitle the Community Operator to seek injunctive relief, damages, and termination of membership, in addition to any other remedies available under law.
12. Acknowledgment
By checking the acceptance box and creating an account, Members acknowledge they have read, understood, and agreed to this Agreement and to the Waiver of Liability & Disclaimer set out in Part II below.
13. Changes to This Agreement
- The Community Operator may update this Agreement from time to time. Each version is identified by a version number and effective date.
- The current version is published at marketeye.io/community-terms. Prior versions remain available at their versioned addresses.
- Where changes are material, the Community Operator will notify Members by email or through the platform before the changes take effect.
- Continued participation in the Community after a revised version takes effect constitutes acceptance of that version.
14. Privacy
Collection and use of Member information is governed by the MarketEye Privacy Policy, available at marketeye.io/privacy, which is incorporated into this Agreement by reference.
15. General Provisions
- Precedence. The Community Agreement (Part I) and the Waiver of Liability & Disclaimer (Part II) are intended to be read together. In the event of a conflict between them, the Community Agreement governs. In the event of a conflict between this Agreement and the Terms of Service on any commercial matter — pricing, billing, refunds, or dispute resolution — the Terms of Service govern.
- Severability. If any provision of this Agreement is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed. All remaining provisions shall continue in full force and effect.
- Entire Agreement. This Agreement, together with the Terms of Service and the Privacy Policy, constitutes the entire agreement between the Member and the Community Operator regarding the Community, and supersedes any prior understandings on the subject.
- No Waiver. Failure by the Community Operator to enforce any provision of this Agreement shall not constitute a waiver of that provision or of any other provision.
- Assignment. Members may not assign or transfer their membership or any rights under this Agreement. The Community Operator may assign this Agreement in connection with a merger, acquisition, or sale of assets.
Part II — Waiver of Liability & Disclaimer
This Waiver applies between MarketEye LLC, operator of MarketEye Society, and each Member.
1. Educational Purposes Only
All information is for educational purposes only. All content, discussions, and materials within the Community are provided for educational and informational purposes only. Nothing contained herein constitutes financial, investment, legal, or tax advice.
2. No Guarantees
No representations or guarantees of profitability. The Community and its Mentors make no representations, warranties, or guarantees regarding trading performance, profits, or results of any kind. Past performance is not indicative of future results.
3. Assumption of Risk
Trading involves substantial risk of loss. By joining the Community, Members acknowledge the high risk of financial loss associated with trading futures, forex, stocks, options, and cryptocurrencies, and assume full responsibility for their own trading and investment decisions.
4. Waiver & Release of Liability
Member waives and releases MarketEye LLC and Mentors. To the fullest extent permitted by law, Members expressly waive and release the Community, its operators, and its Mentors (paid or unpaid) from any and all claims, demands, damages, or liabilities, whether direct or indirect, arising from or related to:
- Trading or investment losses;
- Reliance on educational content, strategies, or discussions within the Community;
- The actions or omissions of other Members or Mentors.
Nothing in this Waiver excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, or willful misconduct, or for any other liability that cannot lawfully be excluded or limited under applicable law.
5. No Fiduciary Relationship
Participation in the Community does not create any fiduciary duty between Members, Mentors, or the Community Operator.
6. CFTC/NFA Risk Disclosure
Futures, forex, stocks, options, and cryptocurrency trading involves substantial risk and is not suitable for every investor. An investor could potentially lose all or more than the initial investment. Risk capital is money that can be lost without jeopardizing one’s financial security or lifestyle. Only risk capital should be used for trading and only those with sufficient risk capital should consider trading.
Hypothetical performance results have many inherent limitations. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown; in fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved. Past performance is not necessarily indicative of future results.
7. Governing Law
This Waiver is governed by, and disputes arising out of or relating to it are resolved under, Sections 13 (Disputes) and 14 (Governing Law) of the Terms of Service.
8. Acknowledgment
By checking the acceptance box and creating an account, the Member affirms they have read, understood, and voluntarily agree to the Community Agreement and this Waiver of Liability & Disclaimer.
